1. Acceptance of Terms

By accessing or using XMR No KYC ("Service"), you confirm that you have read, understood and agreed to these Terms of Use in full. If you do not accept these terms, you must stop using the Service immediately. Continued use constitutes ongoing acceptance.

2. Description of Service

XMR No KYC is a fully automated, non-custodial cryptocurrency exchange platform. Its core function is enabling users to swap supported digital assets for Monero (XMR) without registration or identity verification of any kind. Deposits are detected on-chain, converted at the locked rate, and dispatched to the destination wallet you provided — with no manual step involved at any stage of the process.

3. Eligibility

You must be at least 18 years of age to use this Service. By proceeding, you confirm you meet this requirement. You alone are responsible for ensuring your use of the Service complies with all applicable laws in your jurisdiction, including any restrictions on cryptocurrency exchange, privacy coin usage, or related activities.

The Service is not available to persons located in jurisdictions where cryptocurrency exchange, Monero transactions, or related activity is prohibited by applicable law. Determining your legal eligibility is your responsibility.

4. No Financial Advice

Nothing on this platform constitutes financial, investment, legal or tax advice of any kind. Cryptocurrency markets are volatile and unpredictable. You assume all risks associated with exchanging digital assets. XMR No KYC bears no responsibility for investment losses, exchange rate movements, or any financial outcome arising from your use of the Service.

5. User Responsibilities

• You are solely responsible for the accuracy of the Monero destination address you provide. Transactions sent to incorrect addresses are irreversible and cannot be recovered under any circumstances.
• You are responsible for ensuring all funds submitted for exchange are legally obtained and are not proceeds of any criminal activity.
• You must not use this Service for money laundering, terrorist financing, sanctions evasion, fraud, or any other illegal purpose.
• You are responsible for all applicable tax obligations in your jurisdiction arising from cryptocurrency transactions conducted through this Service.

6. Transaction Finality

Blockchain transactions are irreversible by nature. Once a deposit to a generated address is confirmed on-chain, the swap process starts automatically and cannot be halted, reversed or modified. If you deposited to an incorrect or expired address, contact support immediately with your Order ID and transaction hash — such cases are handled on a best-efforts basis.

7. Exchange Rates and Fees

Exchange rates are fetched live at order creation and locked for 30 minutes. The Monero amount displayed at the time of order creation is based on the locked rate; minor differences may arise from the outgoing Monero network fee. The service fee charged by XMR No KYC is already incorporated into the displayed exchange rate. No additional or hidden charges are applied after an order is confirmed.

8. Prohibited Use

You may not use the Service to:

• Launder money or conceal the origin of criminally obtained funds of any kind
• Finance terrorism, extremist organizations, or entities subject to international sanctions
• Circumvent economic sanctions imposed by any recognized international authority
• Process ransomware payments or proceeds from darknet market activity
• Engage in fraud, theft, or the handling of stolen cryptocurrency
• Violate any applicable local, national, or international laws or regulations

9. Limitation of Liability

To the fullest extent permitted by applicable law, XMR No KYC shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of funds caused by incorrect destination addresses, blockchain network delays or congestion, exchange rate fluctuations, or service interruptions of any kind.

Our aggregate liability to you for any claim arising from these Terms or the Service shall not exceed the total transaction fees paid by you in the 30 days immediately preceding the claim.

10. Service Availability

We aim for continuous 24/7 availability but do not guarantee uninterrupted access. The Service may be suspended or temporarily unavailable due to maintenance, security incidents, or legal compliance requirements. We will restore access as quickly as reasonably possible.

11. Changes to Terms

We reserve the right to modify these Terms of Use at any time. Updated terms will be posted on this page with a revised date. Continued use of the Service following any modification constitutes your acceptance of the updated terms.

12. Governing Law

These Terms of Use are governed by applicable law. Any disputes arising from or related to these Terms or your use of the Service shall be resolved through binding arbitration or in a court of competent jurisdiction.
